The form is currently being revised, and the commenter’s recommendations will be considered as part of that revision process. Currently, the Form 8857 instructions explain that IRS must notify the non-requesting spouse that relief was requested, even in cases involving abuse. The instructions also advise that requesting spouses should blackout personal information from submitted materials if they do not want that information disclosed to the non-requesting spouse.
