NOTE TO THE REVIEWER
The Office of Management and Budget (OMB) did not approve this Information Collection Request (ICR) at the proposed rule stage and issued terms of clearance for the most recent submission of this paperwork package. See ICR Reference Numbers 200709-1215-004 and 200702-1215-001. Specifically, the OMB instructed the Department to resubmit this collection for approval if any changes were made as a result of public comments submitted in response to the December 2006 request for information on the FMLA. The attached submission addresses those terms.
The military family leave provisions of The National Defense Authorization Act for FY 2008 amend the FMLA to provide leave to eligible employees of covered employers to care for covered servicemembers and because of any qualifying exigency arising out of the fact that a covered family member is on active duty or has been notified of an impending call to active duty status in support of a contingency operation. The new statutory provisions will be codified at 29 U.S.C. 2612(e)(2) and (e)(3).
