The Commission is proposing the
reporting and record-keeping requirements contained in the attached
federal register release in order to establish an effective,
efficient , and comprehensive position limits regime. Congress
mandated in Section 4a(a)(2) and 4a(a)(5) of the Commodity Exchange
Act that the Commission establish federal limits on speculative
trading with regard to physical commodity futures contracts (and
options) along with swaps that are economically equivalent to such
futures.
