Under the Omnibus Transportation Employee Testing Act of 1991, DOT is required to implement a drug and alcohol testing program in the Transportation industry. This specific requirement is elaborated in 49 CFR Part 40 (Procedures for Transportation Drug and Alcohol Testing Programs).

Changing Regulations
The program change of 53,860 burden hours was a result of a regulatory change in which the random alcohol testing rates for each DOT agency was reduced to from 25% to 10%. The adjustments of 104,097 burden hours is mostly represented by a reduction in the number of requests for information from previous employers(34,545 hours).
