A new category of registrant - retail foreign exchange dealers - and previously unregistered intermediaries are, for the first time, required to register pursuant to amendments to the Commodity Exchange Act contained in the Food, Conservation, and Energy Act of 2008, Pub L. No. 110-246, 122 Stat. 1651, 2189-2204 (2008). The number of entities required to register under Part 3 has, therefore, increased.

Overall, estimated burden hours are increased due to an increase in the number of persons expected to apply for and maintain registration. The total number of registrants has decreased from year to year due to several factors, including, among other things, the adoption by the Commission of regulations that provide additional exemptions from the requirement to register as a commodity pool operator or as a commodity trading advisor, and the industry trend away from open outcry trading to electronic trading. In many cases, existing registrants have withdrawn from registration, claiming exemption under the new regulations. However, the Farm Bill requires the Commission to register individuals and entities not previously required to register, and the increase in burden hours reflects the Commission’s estimate of the number of new registrants.
